Bikram Paul v. The State of Assam

¶1Heard Mr. A. R. Bhuyan, learned counsel for the petitioner. Also heard Mr. R. R. Kaushik, learned Additional Public prosecutor for the State of Assam.

¶2This is an application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, praying for pre-arrest bail in respect of Silchar Police Station Case No.830/2024. Page No.# 2/2

¶3It is alleged in the FIR, that the petitioner being an employee of Mahindra & Mahindra Financial Services Limited had collected Rs.5,000/- from one particular customer and instead of depositing the said money in the office, he deposited the money in his own Bank account.

¶4The learned counsel for the petitioner has submitted that the petitioner has already returned the said amount of Rs.5,000/-.

¶5On the other hand, learned Additional Public Prosecutor has pointed out that in the original complaint lodged against the present petitioner, there are some allegations that the petitioner had misappropriated large amount of money.

¶6I have considered the submissions made by learned counsel for both the sides.

¶7It appears that the case has been registered for misappropriation of Rs.5,000/-. Therefore the petitioner does not deserve to be detained in custody.

¶8Therefore, the pre-arrest bail prayers made by the present petitioner is allowed.

¶9It is hereby directed that in the event of arrest in connection with Silchar Police Station Case No.830/2024, the petitioner Bikram Paul shall be released on bail of Rs.20,000/- with a surety of like amount to the satisfaction of the arresting authority.

¶10The petitioner shall appear before the Police Investigating Officer within next 10 days from today.

¶11The petitioner shall co-operate with Police Investigation as and when required

¶12Case Diary shall be returned.
