ORDER

27.11.2024 Heard Mr. R.A. Choudhury, learned counsel for the petitioner. Also heard Mr. C. Sarma, learned counsel appearing for the Water Resources Department and Ms. U. Das, learned counsel for the respondent No.9.

¶2The petitioner claims payment of outstanding contractual dues amounting to Rs.2,62,701/-.

¶3Mr. C. Sarma, learned counsel appearing for the Water Resources Page No.# 3/3 Department submits that though the claim of the petitioner has been admitted, the same has not been paid due to want of funds.

¶4I have heard the learned counsels for the parties.

¶5On perusing the affidavit filed by the respondent No.4, this Court finds that there has been no denial with regard to the claim of the petitioner that outstanding contractual dues of Rs.2,62,701/- has not been paid to the petitioner, due to want of funds.

¶6In view of the admission made by the State respondent No.4, this writ petition is disposed of with a direction to the respondents, to make available the funds and pay to the petitioner the admitted dues of Rs.2,62,701/-, within a period of 3(three) months from the date of receipt of a certified copy of this order.

¶7The writ petition is accordingly disposed of.
