ORDER
11.12.2024
Heard Mr. B K Mahajan, learned counsel for the petitioner and Mr. R R Kaushik, learned Additional Public Prosecutor, Assam. By this application filed under Section 483 of the BNSS, 2023, the petitioner Rupankar Page No.# 2/2 Pathak @ Rinku, has prayed for release on bail, who was arrested in connection with Bharalumukh P.S. Case No. 210/2024. One 47 years old woman has alleged in the FIR that she was maintaining relationship with the present petitioner for a period of 10 to 12 years. They had physical relationship also. The petitioner promised that he would marry her. But, on 25.11.2024, the petitioner married another girl. Therefore, the informant has alleged that the petitioner had cheated her. It has been submitted by the petitioner that since the year 2018, he was not maintaining relationship with the informant. I have considered the submissions made by the learned counsel of both sides in the light of the contents of the FIR. This court is of the opinion that the petitioner does not deserve to be detained in custody for further period of time under the given circumstances. Therefore, the bail application is allowed. Accordingly, it is directed that the petitioner Rupankar Pathak @ Rinku, who was arrested in connection with Bharalumukh P.S. Case No. 210/2024, shall be released on bail of Rs.20,000/- with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup
(M), Guwahati. Bail application is disposed of.
