Judgment

ORDER Date : 02.12.2024

Heard Mr. F.A.Laskar, learned counsel for the applicant. Also heard Ms. B.Sharma, learned CGC appearing for the Union of India/opposite party. By filing this interlocutory application under Section 5 of the Limitation Act, 1963, the applicant has prayed for condonation of delay of one day in filing Page No.# 2/2 the connected first appeal. Learned counsel for the applicant submits that due to sudden demise of his mother, he has suffered heavy financial crisis and he being an unemployed youth could not approach before this Hon'ble Court in due time and as such, delay of one day has been occurred in filing the connected first appeal. Hence, delay may be condoned. Learned counsel for the Opposite party has no objection against the prayer of the applicant. Upon hearing the learned counsel for both sides and considering the grounds cited in the application, the delay of one day in filing the connected first appeal is hereby condoned. Registry to register the connected first appeal and list the same for admission hearing. The interlocutory application stands disposed of.
