Altaf Raja v. The State of Assam

¶1Heard Mr. S. M. Abdullah P, learned counsel for the petitioner Altaf Raja.

¶2The petitioner has filed this application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 with prayer for bail as he is Page No.# 2/3 behind bars since 19.10.2024 in connection with Sipajhar P.S. Case No. 162/2024 under Sections 319(2)/318(4)/308(2)/309(7)/351(2) of the BNS.

¶3Heard Mr. R. R. Kaushik, learned Additional Public Prosecutor, Assam for the respondent State.

¶4I have considered the submissions at the Bar.

¶5The allegation against the petitioner is that he has demanded Rs. 20,000/- from the owner of a Scooty bearing registration no. As-27D-4794 in the name of the informant, SI, Dipjyoti Das.

¶6I have considered the submission that the petitioner has been behind bars for 41 days.

¶7It appears that investigation may have presumably progressed substantially and the petitioner has pledged to cooperate with the remaining part of investigation and to abide by any stringent bail conditions, if imposed upon him.

¶8Considering all aspects, petition is allowed. The petitioner shall be enlarged on bail of Rs. 30,000/- with a suitable surrey of like amount to the satisfaction of the Elaka Magistrate under the conditions that:

(i) The petitioner shall cooperate with the remaining part of investigation and appear before the Investigating officer on every fortnight till completion of investigation, and

(ii) The petitioner shall refrain from such activities with which he is alleged. Page No.# 3/3

¶9On breach of any of the bail conditions, the Court is at liberty to cancel the order granted to the petitioner.

¶10In terms of the above observation, bail application stands disposed of.
