Heard Ms. S. Yesmin, learned counsel for the petitioner and Mr. R R Kaushik, learned Additional Public Prosecutor, Assam. By this application, filed under Section 482 of the BNSS, 2023, the petitioner, namely, Sahabuddin Ahmed, has prayed for pre-arrest bail, who apprehends arrest in connection with Dispur P.S. Case No. 1227/2024. According to the FIR, the petitioner alleged that the informant did not have genuine educational certificates issued by any University and with false documents he was working as a Page No.# 2/2 Teacher in a government school. Thereafter, the informant and the present petitioner all appeared before the Director of Higher Education, Kahilipara and the Director found that the documents, on the basis of which, the informant was working are genuine and, therefore, the present petitioner was handed over to Police. Police registered a case on the basis of the FIR lodged by the informant. The statement of the petitioner was recorded. He was released by the Police. I have considered the submission made by the learned counsel for both sides. This court is of the opinion that under the given circumstances the petitioner does not deserve to be detained in custody. Hence, the prayer for pre-arrest bail of the petitioner is allowed. Accordingly, it is hereby directed that in the event of arrest of the petitioner, namely, Sahabuddin Ahmed, who apprehends arrest in connection with Dispur P.S. Case No. 1227/2024, the arresting authority shall release him on bail of Rs.20,000/- with one surety of like amount to the satisfaction of the arresting authority. The petitioner is directed to cooperate in the investigation as and when required. The bail application is disposed of.
