Judgment
ORDER
06.12.2024
Heard Mr. S Islam, learned counsel for the petitioner and Mr. D Das, learned Additional Public Prosecutor, Assam. This is the 2nd application filed under Section 482 of the BNSS,2023 in respect of Moirabari P.S. Case No. 119/2024 by the petitioners Taffajul Islam and Merajul Islam. On 24.10.2024 in AB No. 2605/2024, the anticipatory bail of the present petitioner was rejected by this court after perusal of the Case Diary. Now, the 2nd bail application has been filed only on the ground that the learned Sessions Judge, Morigaon had allowed the bail prayer of the co-accused, who was arrested earlier. This is not a new ground for seeking anticipatory bail. Therefore, in failure to show any new ground, the present bail application of the petitioner is found to be devoid of merit and stands dismissed and disposed of accordingly.
