04.12.2024 Heard Mr. M Baruah, learned counsel for the petitioners and Mr. K K Parashar, learned Additional Public Prosecutor, Assam for the State. 2) By this application filed under Section 483 BNSS, 2023, the petitioners, namely, (i) Diganta Chetia, son of Late Budheswar Chetia and (ii) Luchan Gogoi, son of Lalit Gogoi, are praying for their bail in Sivasagar Police Station Case No.115/2024, registered under Sections 310(2) BNS, 2023 read with Section 25 (1-B)(a) of the Arms Act, wherein, they were arrested on 06.09.2024 and are in custody since then. 3) On instruction of the petitioners, their counsel Mr. M Baruah is not pressing this pre-arrest bail application filed by the petitioners in Sivasagar P.S. Case No.115/2024 by submitting that the petitioners shall approach the appropriate forum/authority seeking necessary relief, to which Mr. Parashar, learned APP, Assam has no objection. 4) Accordingly, this pre-arrest bail application, being not pressed, stands dismissed.
