Sahidul Islam v. The State of Assam

ORDER Date : 13.12.2024 Heard Mr. M.Khan, learned counsel appearing for the petitioner. Also heard Mr. D. Das, learned Additional Public Prosecutor for the state of Assam.

¶2This an application u/s 483 of the BNSS, 2023, whereby the petitioner, Sahidul Islam has prayed for releasing him on bail, after he was arrested in connection with Serfanguri P.S. Case No. 22/2024. Page No.# 2/2

¶3Mr. Das has submitted that police has filed the charge-sheet being Charge Sheet No. 23/2024 dated 11.12.2024.

¶4Mr. Khan submits that the petitioner has already spent 50 days in custody.

¶5I have considered the submissions made by the learned counsels of both sides. I have also gone through the FIR.

¶6This Court is of the opinion that inspite of charge sheet being already filed against the petitioner, the petitioner no longer deserves to be detained in custody. Therefore, his bail application is allowed.

¶7It is hereby directed that the petitioner, Sahidul Islam, who was arrested in connection with Serfanguri P.S. Case No. 22/2024, shall be released on bail of Rs. 25,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kokrajhar.

¶8The WT message sent by the Investigating Officer shall form a part of the record.
