Judgment
ORDER Date : 11.11.2024
Heard Mr. D.Chutia, learned counsel for the applicant. Also Heard Mr. D.P.Goswami, learned Addl. Public Prosecutor, Assam appearing for the State respondent No.1. By filing this interlocutory application, the applicant has prayed for correction in the Cause Title of the connected criminal revision petition wherein a typographical error in the Cause Title has occurred under Section 338 r/w Section 442 instead of Section 438/528 of the BNSS, 2023. Learned counsel for the applicant, submits that inadvertently, a typographical error has occurred in the connected Criminal Revision Petition No.400/2024 wherein in the Cause Title instead of 'Section 438 r/w Section 528 of BNSS, 2023 the same has been wrongly typed as 'Section 338 r/w Section 442 of the BNSS, 2023'. After hearing the learned counsel for the applicant and considering the grounds cited in the petition, the prayer for correction as sought for by the applicant is allowed. Accordingly, instead of 'Section 338 r/w Section 442 of the BNSS, 2023' the same shall be read as 'Section 438 r/w Section 528 of BNSS, 2023' in the connected Criminal Revision Petition /400/2024. Registry to do the needful. With the above direction, the interlocutory application stands disposed of.
