Heard Mr. A.R. Bhuyan, learned counsel for the petitioner. Also heard Mr. S. Dutta, learned Standing Counsel, Revenue Department and Ms. A. Talukdar, learned Government Advocate for the State respondents. By way of this writ petition under Article 226 of the Constitution of India, the petitioner is assailing the appointment of respondent No. 6 to the post of Gaon Pradhan for Dhupguri, Bhuyabari Pam & Bhuyabari Pathar Kissam. It is submitted at the bar that the petitioner has filed an appeal before the Divisonal Commissioner, Central Assam Division, which is now being forwarded to the office of the Director of Land Record & Survey and the same is pending. In view of the aforesaid endorsement made by the learned counsels for the parties, this Court deems appropriate to dispose of this writ petition at the Page No.# 3/3 motion stage itself, by directing the appellate authority (Director of Land Record & Survey) to dispose of the said appeal, if any, filed by the petitioner within a period of 3 (three) months from the date of receipt of a certified copy of this order. The writ petition is accordingly disposed of. It is needless to clarify that the appellate authority shall give full opportunity to the petitioner and the private respondents and other stake holders during the hearing of the appeal.
