¶1Heard Mr. L. C. Gogoi, learned counsel for the petitioner Kamal Bora @ Pankaj Bora.

¶2The petitioner has filed this application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 with prayer for bail as he is behind bars since Page No.# 2/2

04.09.2024 in connection with Kachua P.S. Case No. 89/2024 under Section 103(1) of the BNS.

¶3Heard Mr. B. Sharma, learned Additional Public Prosecutor, Assam for the respondent State.

¶4Learned Additional Public Prosecutor has raised serious objection stating that there are incriminating materials in the Case Diary against the petitioner.

¶5I have considered the submissions at the Bar with circumspection. I have scrutinized the Case Diary.

¶6The direct allegation against the petitioner is that he has committed murder of the informant's husband.

¶7As the investigation is still under progress, it appears that investigation may be adversely affected if the petitioner is admitted to bail at this stage. Thereby, I am constrained to reject the bail petition at this stage of investigation.
