Heard Mr. SI Akand, the learned counsel appearing on behalf of the petitioner. Also heard Ms. G Hazarika, the learned Standing Counsel, Revenue and Disaster Management Department, Govt. of Assam

¶2This Court vide order dated 11.09.2024, requested Ms. G Hazarika, the learned Standing Counsel, Revenue and Disaster Management Department, Govt. of Assam to obtain instruction(s) from the respondents as to whether the order dated 13.09.2023 passed in WP(C)No.3389/2023 has been complied with or not.

¶3Today, Ms. G Hazarika the learned counsel has placed before this Court the instruction(s) dated 24.09.2024 issued by the Joint Secretary to the Government of Assam, Revenue & Disaster Management Department wherein it has been mentioned that in compliance to the order passed by this Court, the Revenue and Disaster Management Department has released the budget allotment of Rs.2,00,000/- for the next of the kin of Late Swaraj Chandra Roy to the D.D.O concerned vide online budget for making payment of the ex-gratia payment to the petitioner in the instant case. The said instruction(s) is kept on record and marked with the letter 'X'.

¶4Taking into account that the amount of Rs.2,00,000/- to which the petitioner herein would be entitled to has already been released to the D.D.O, concerned, the counsel for the petitioner submits that he would not like to press the instant contempt petition.

¶5Accordingly, the contempt proceedings stands dropped. Page No.# 3/3
