Bablu Ahmed Barbhuiya and 4 Ors v. The State of Assam

ORDER 27-11-2024 Heard Mr. A M Khan, learned counsel for the petitioners and Mr. B Sarma, learned Additional Public Prosecutor, Assam for the State.

¶2By this application under Section 482 BNSS, 2023, the petitioners, namely, (i) Bablu Ahmed Barbhuiya, (ii) Afridi Ahmed Barbhuiya, (iii) Sahid Ahmed Barbhuiya, (iv) Rubel Hussain Barbhuiya, all sons of Giyas Uddin Barbhuiya and (v) Giyas Uddin Barbhuiya, all resident of village-Ganiwala, P.S.-Silchar, District-Cachar are seeking pre-arrest bail in Silchar Police Station Case No. 743/2024 registered under Sections 324(4)/ Page No.# 3/3 127(2)/74/3(5) of BNS, 2023, corresponding to G.R. No. 1498/2024.

¶3During the deliberation of the matter, Mr. B Sarma, learned APP, Assam, on instruction, has submitted that police after completion of the investigation of the case has already submitted Charge-Sheet in said Silchar Police Station Case No. 743/2024 vide Charge Sheet No. 776/2024 dated 31.08.2024.

¶4In view of the above, the petitioners are directed to appear before the appropriate forum/authority for their regular bail in said Silchar Police Station Case No. 743/2024 on or before 06.12.2024.

¶5Till then, i.e., 06.12.2024, the petitioners shall remain on interim bail granted to them earlier on 06.09.2024.

¶6Accordingly, this pre-arrest bail application stands disposed of.
