Mr. A. K. Baruah, the learned counsel appearing on behalf of the Petitioner submits that he has instructions to withdraw the instant writ petition. He however submits that the withdrawal of the instant writ petition should not bar the Petitioner to approach the appropriate authorities for the purpose of seeking settlement in terms with the provisions of the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (for short 'the Act of 2006').

¶2Taking into account the above, the instant writ petition stands closed on withdrawal.

¶3Interim order passed if any, stands vacated.

¶4The withdrawal of the instant writ petition shall not preclude the Page No.# 3/3 Petitioner to approach the appropriate authorities in terms with the Act of 2006, if otherwise eligible under law.

¶5The instructions so produced by Mr. I. Borthakur, the learned Standing counsel for the Forest Department is kept on record and marked with the letter "X".
