¶2The learned counsel for the Revenue Department submitted that taking into account the documents on record, it would show that the petitioner was hit by a vehicle bearing Registration No. AS 07C 5327 and as such the petitioner is not entitled to the benefit of ex-gratia in terms with the Notification dated 15.11.2014.

¶3The learned counsel appearing on behalf of the Revenue Department has further placed before this Court the order dated

21.06.2024 passed by the Co-ordinate Bench of this Court in Monisa Khatun @ Monisha Khatun Vs. State of Assam and 5 Ors.(WP© No. 2700/2023) wherein it has been categorically provided that the benefit under the Notification dated 15.11.2014 would not be available in respect Page No.# 3/3 to such claims, wherein the vehicle which had caused the accident have been identified.

¶4Taking into account the judgment passed by the Co-ordinate Bench of this Court in Monisa Khatun @ Monisha Khatun (supra), the instant writ petition stands dismissed. JUDGE Comparing Assistant
