Judgment

ORDER Date : 25.11

. 2024 Heard the learned counsel Mr. N.K. Bora for the petitioner, Mrs. Barnali Bordoloi Terron @ Barnali Terron, who has filed this bail application under 482 BNSS, 2023 with a prayer for pre-arrest bail as he is apprehending arrest in Page No.# 2/3 connection with Basistha P.S. Case No. 545/2024 under Sections 316(2)/ 318(4)/ 3(5) of BNS, 2023.

¶2Heard Mr. D. Das, learned Addl. Public Prosecutor, Assam, appearing for the State respondent.

¶3The learned Addl. PP has raised objection against the prayer of pre-arrest bail.

¶4The FIR unfolds that the petitioner alongwith other co-accused named in the FIR opened a "DAAI Trading App" and on the pretext of returns in the invested money, misappropriated huge amount of funds and then cheated the innocent citizens.

¶5It is submitted on behalf of the petitioner that the petitioner herself has fallen victim to the misdeed of the accused, Naresh Kumar Reddy. He is the person who has initiated the DAAI Trading App. The petitioner's husband has also lodged an FIR against the accused Naresh Kumar Reddy which is marked as Annexure-1 of the petition.

¶6The petitioner has also submitted that the other co-accused i.e. her husband, Sunil Kumar Terron @ Sunil Terron has already been granted interim pre-arrest bail by this court in connection with AB No. 2135/2024, vide order dated 16.08.2024.

¶7I have considered the submission that the petitioner is willing to co-operate with the investigation. The petitioner is a local resident and not a flight risk. It appears that there are sufficient grounds to grant the pre-arrest bail to the petitioner.

¶8The case diary is received and perused. Page No.# 3/3

¶9I have considered the submissions of the learned counsel for the parties at the bar with circumspection.

¶10I have scrutinized the case diary. The merits of the case are not brought to the fore as the case is still at the stage of investigation.

¶11The petitioner is already on interim bail granted by this Court. The petitioner has appeared before the I.O. and has co-operated with the investigation. The petitioner has not violated any conditions of the interim bail granted to him.

¶12Considering the entire aspect of the matter and in view of my foregoing discussions, the interim order dated 29.08.2024 is hereby made absolute subject to the conditions contained in the interim order itself.

¶13Bail application is disposed of.

¶14Send back the case diary.
