Heard Ms. K. Verma, learned counsel for the petitioner. Heard Mr. D.P. Goswami, learned Additional Public Prosecutor for the State of Assam.

¶2This is an application for restoration of Criminal Petition being Crl.Pet No. 102/2024 filed by the applicant, which has been dismissed for non-prosecution on 14.08.2024 by this Court.

¶3It is submitted by the learned counsel for the petitioner that on 22.07.2024 and 14.08.2024 she remained absent when the matter was called for. Thereafter, this Court dismissed the petition on the ground of non-prosecution on 14.08.2024.

¶4The learned counsel for the petitioner further submits that she was entrusted with proceedings of the aforesaid case but on two occasions she was not in a position to attend the Court due to her illness, but which is not intentional. And as such the learned counsel for the petitioner prays to restore the criminal petition being Crl.Pet No. 102/2024.

¶5In support of her submission, the learned counsel for the petitioner has submitted her Medical Report which shows that she was suffering from frozen Page No.# 3/3 shoulder during that period and she was taking treatment from doctor and doctor advised her to take bed rest.

¶6The learned Addl. P.P has submitted that he has no objection if the Crl.Pet No. 102/2024 is restored to file.

¶7Having heard the learned counsels for the parties and considering the submission of the learned counsel for the petitioner, the Crl.Pet No. 102/2024 is restored to file.

¶8Accordingly, this Interlocutory Application stands disposed of.
