Judgment
ORDER 06-11-2024 (S. K. Medhi, J) Heard Shri H. A. Ahmed, learned counsel for the applicant, who has filed this application for condonation of delay of 9 days in preferring the appeal. The appeal has been preferred under Section 21 (4) of the NIA Act, 2008 against the order dated 15.06.2024 passed by the learned Special Judge, NIA, Assam in Misc. (NIA) Case No. 34/2024 arising out of Special NIA Case No.03/2023 (RC-02/2022/NIA-GUW) by which the prayer for bail of the applicant has been rejected. Also heard Shri D. Bharadwaj, learned PP, NIA who submits that he would not have serious objections to the aspect of condonation of delay. He however adds that no case for interference with the order of the learned Court has been made out. Considered the submissions advanced along with the pleadings made in paragraphs 4 & 5. After consideration of the same and also taking into account that the delay is of 9 days, the same is condoned. The IA accordingly stands allowed. In view of the condonation of the delay, the criminal appeal may be registered and listed for admission after a week. JUDGE JUDGE Comparing Assistant
