16.09.2024 Heard Mr. F.A. Hassan, learned counsel for the applicant and also heard Mr. A.R. Das, learned counsel appearing on behalf of Mr. R.C. Paul, learned counsel for the respondent/opposite party No.1 and Mr. M. Hussain, learned counsel for the respondent No.2. This interlocutory application is preferred by the applicant Wahida Begum for allowing her to withdraw a sum of Rs.2,00,000/-, which has been deposited by the respondent No.1/appellant insurance company with the Registry of this Court pursuant to the order passed by this Court in MFA No.5/2024, vide order dated 24.01.2024. Perused the application and the documents placed on record. After hearing learned Advocates of both sides and also considering the facts and circumstances on the record, it is provided that the amount deposited with the Registry of this Court, shall be released in favour of the applicant Wahida Begum, without any rider, after due identification.
