Bajaj Allianz General Insurance Company Limited v. Pinki Rudrapaul and 2 Ors

Mr. Nayan Choudhury, Hub In-Charge, Appeal and Specialized Claims of Bajaj Allianz General Insurance Company Ltd., the appellant along with Mr. P.N. Talukdar, learned counsel for the appellant.

¶2Respondent nos.1 to 3 along with Mr. S. Roy, their learned counsel are present.

¶3After negotiated settlement, the parties have agreed for a total settlement amount of Rs.19,50,000/- (Rupees nineteen lakh fifty thousand only) as full and final settlement of all the claims of the respondent nos.1 to 3 against the judgment and award dated 07.11.2023, passed by the learned Member, Page No.# 3/4 Motor Accident Claims Tribunal, Karimganj in MAC Case No. 84/2020.

¶4Accordingly, the matter is settled on compromise in terms of the pre-settlement/compromise slip for the National Lok Adalat, which is made as a part of record.

¶5Both the parties shall put their signature in the pre-settlement compromise slip as token of acceptance for the settlement.

¶6Accordingly, the Bajaj Allianz General Insurance Company Ltd./ appellant shall deposit the settlement amount of Rs.19,50,000/- (Rupees nineteen lakh fifty thousand only) in favour of the respondent nos.1 to 4 before Motor Accident Claims Tribunal, Karimganj within a period of 30 (thirty) days from the date of the this settlement order, failing which the amount shall carry interest @ 9% per annum till the date of deposit.

¶7On such deposit being made, out of the settlement amount, a sum of Rs.6,00,000/- (Rupees six lakh only) shall be kept in a fixed deposit account in the name of Bishwajit Rudrapaul (minor), who is respondent no.2 herein till he attain the age of majority and Rs.6,00,000/- (Rupees six lakh only) shall be released to the respondent no.3 and the balance amount shall be released to respondent no.1 satisfaction of their identity.

¶8On furnishing proof of the deposit of the entire settlement amount, the Registry shall release the statutory deposit made by the appellant.

¶9The matter is disposed of in this Lok Adalat.
