Heard Ms. F.N. Zaman, learned counsel for the applicant. I have also heard Mr. M. More, learned counsel appearing on behalf of the respondents. This is an application under Section 173 Proviso of the M.V. Act, 1988 for condoning the delay of 3 days in filing the connected appeal against the judgment and award dated 19.09.2023 passed by the learned Motor Accident Claims Tribunal, Kamrup (M), Guwahati. The delay in not filing the connected appeal on time has been explained in paras 4 and 5 of the application. The applicant has been able to satisfy that he had a sufficient cause for not filing the connected appeal on time. Moreover, the learned counsel for respondents has no objection if the delay of 3 days in preferring the connected appeal is condoned. In view of above, the delay of 3 days in filing the connected appeal is hereby condoned. The Office shall register the connected appeal and place for admission on a date to be fixed by the Registry.
