Mr. Rubul Chandra Pathak, Dy. Manager, Oriental Insurance Co. Ltd is present and the respondent no.1/claimant, namely, Sri. Niranjan Das, along with Mr. S. Das, his learned counsel are present.

¶2Both sides have agreed that the pre-settlement held between the parties and the appellant has agreed to pay a sum of Rs.5,00,000/- (Rupees five lakh only) as full and final settlement of all the claims of the respondent no.1/claimant against the order and award dated 09.12.2019, passed by the learned Member, Motor Accident Claims Tribunal No.1, Kamrup in MACT Case No.238/2017.

¶3Out of total settlement amount, a sum of Rs.3,14,000/- (Rupees three lakh fourteen thousand only) has already been paid to the respondent no.1 by the appellant Insurance.

¶4The appellant shall deposit the balance amount of Rs.1,86,000/- (Rupees one lakh eighty six thousand only) before the Registry of the Court within 30 (thirty) days from the date of the settlement order, failing which the amount shall carry interest @ 9% per annum till the date of deposit.

¶5On such deposit being made, the Registry of the Court shall disburse the said amount in favour of the respondent no.1/claimant, namely, Sri. Niranjan Das, on satisfaction of his identity. Page No.# 3/3

¶6On furnishing proof of the deposit of the entire settlement amount, the Registry shall release the statutory deposit made by the appellant.

¶7The matter is disposed of in this Lok Adalat.
