Summons issued in ordinary course to defendant nos. 1&2 has been received back unexecuted. However the registry has written that nobody came to collect the dasti and speed post summons.
Learned counsel for plaintiff has stated that since jurisdictional value of the present suit is less than two crore and the same is a non-commercial suit, therefore, the same may be transferred to concerned District court having pecuniary and territorial jurisdiction. He has no objection to the transfer of the suit to South District, Saket Court since defendant nos. 1& 2 are based in Green Park. Accordingly in view of notification no.27187/DHC/Orgl. dated
24.11.2015, the present matter stands transferred. Parties are directed to appear before the Court of Ld. District Judge, South District, Saket Court Complex, Delhi on 26.09.2016 at 10.00 a.m.
