ORDER
28.11.2011 This is a petitionunder Section 482 CrPC read with Article 227 of the Constitutionagainst the order dated 20.11.2010 of learned ASJ whereby th^ revision petition filed against the order dated 03""^ June, 2010 of MM was dismissed. The present petitionhas been filed by the petitionermainly on the ground, allegingthat the said revisionfiled againstthe orderof M.M. was not decidedty learned ASJ on merits as it was decided in terms of the judgment of this court in case RajeevPreenjaVs. Sarika& Ors. Reportedas II (2009)DMC 26. No othsr questionhas beenraisedin the presentpetition. Certify that the digital file and physical file have been compared and the digital data is as per the physical file and no page is missing. The learnedcounselappearingfor the respondentsstatesthat a sum of Rs.
3.69 lakhs is outstanding from the petitioner. To this, it is stated by learned counselbythepetitionerthat there is some mistakein the calculationas made out by the respondentsin Para 4 of the appHcationbeing Crl.M.A. 18433/2011filed by the respondents. On this, both the counsels have made calculationwhich comes out to Rs. 2.89 lakhs as arrears. I have perused the order of learned M.M. and the impugned order of learnedASJ. Admittedly, the petitionerhas not paid the arrears of maintenanceas above. In view of the decision of Rajeev Preenja Vs. Sarika & Ors. (supra), the revision was rightly dismissedby the court of learned ASJ vide the impugned order. Thus, I find no illegality or infirmity in the said order. Petition is accordingly dismissed. ^ NOVEMBER 28, 2011 akb M.L. MEHTA,J
