Respondent Nos. 2 & 3 are also present in person and are identified by their counsel. Ms. Meenakshiwas married with Mr. Dhiraj on 23'^'' January, 2004. They have a daughter, namely, Divya out of this wedlock. She is presently in the custody of her mother, i.e., petitioner No. 1, Ms. Meenakshi. Now there is an irretrievable break in the marriage of the couple. They > have already filed a petition for grant of divorce by mutual consent. The first motion petition has already been allowed. Since the parties have arrived at a settlement, no useful purpose will be served in keeping the FIR pending. Hence the FIR No. 35/2006, P.S. Prashant Vihar, under Section 324/451/506/34IPC, is quashed. The parties shall be bound by the terms of MOU. Bail bond is cancelled.
