BAIL APPLN. 1605/2010

Judgment

ORDER

¶1This application has been made by accused Shaukat @ Mushir seeking bail in a case under Section 364-A/366/376/302/102-B/34 IPC.

¶2Facts of the case, in brief, has been narrated by this Court in Crl. Rev. P. No. 404 of 2010 and the same are not being repeated here. The Trial Court refused to grant bail to the applicant on the ground that the applicant had involvement in other cases being FIR No. 627/2006, u/Section 332/341/308/506/34 IPC and FIR No. 414/2006 u/Section 341/323/506 IPC both registered at P.S. Bhajanpura and because no evidence had been recorded in the present case and there were complaints made by witnesses of receiving threats.

¶3I consider that looking at the severity of charges and the cruel manner in which the girl Gulista was put to death after rape, and the prima facie involvement of the applicant, the Trial Court rightly dismissed the application of the applicant. I find no force in this bail application. Dismissed.
