JUSTICE SHIV NARAYAN DHINGRA (Oral)

This revision petition under Section 397/401 Cr.P.C. has been filed against framing of charges by the Special Judge-IV, (PC Act) CBI, Delhi

In view of judgment rendered in Dharambir Khattar v. CBI 159(2009) DLT 636, no revision lies against framing of charges. This Court also reiterated the same view in Om Parkash v. CBI 2010 VI AD (Delhi) 849.

I, therefore, consider that the present revision filed by the petitioner against charge framed by the Special Judge, CBI was not maintainable and is liable to the dismissed and is hereby dismissed.
