¶1By this petition, petitioners are seeking setting aside of the order dated 3'd August 2010 passed by learned Metropolitan Magistrate issuing NBWs for their appearance in Court.

¶2On 19th August 2010, learned counsel for the petitioners sought stay of proceedings before the trial court and offered to deposit the entire cheque amount with the trial court. On 25th August 2010, learned counsel for the petitioners informed that he has already deposited <4,00,000/- in the trial court and balance amount would be deposited in the trial court in two instalments latest by 1" October 2010 and L't November 20L0 respectively. It is submitted by learned counsel for the petitioners that entire cheque .amount has been paid, pursuant to the above undertaking, to the respondent. Since the petitioners have paid the cheque amount to the respondent to show their bona fide, NBWs issued against them, vide order dated 3'd August 2010 are directed to be revoked, subject to the condition that the petitioners shall appear before the trial court in person on the next ......2t_ Certify that the digital and physical file have been compared and the digital data is as per the physical file and no page is missing. ::2:: date of hearing, failing which the trial court shall be within its right to issue appropriate Process.
