26.04.20tti ..... Appellant ..... Respondent +cM 14030/2007 I This application has been made for condonation of delay of more than 900 days. The only ground given by the appellant is that he had asked one Mr. Anup Singh Saroha, Advocate to file appeal. Mr. Anup Singh Sarohq Advocate, obtained thumb impression of the appellant/claimant and thereafter he did not file the appeal and returned the file in the year 2007 i.e. after about three years. It is submitted that a complaint was made,to Delhi Bar Association against Mr. Anup Singh Saroha, Advocate. The deceased, aged about 52 years, was a Head constable in Delhi police. His children must have received some education. It cannot be believed that each one of his sons and daughters was illiterate as sought to be projected. The ground taken for not filing the appeal for about three years seems to be false ground. Even complaint filed against the Advocate before Delhi Bar Association is no complaint as Bar Association has no power to entertain a complaint against professional mis-conduct of an Advocate. It is only Delhi Bar Council which entertains complaints against the professional mis-conduct of the Advocates. Under these circumstances, I find no force in this application.
