¶1By way of the present petition, the petitioner seeks quashing of the FIR bearing No. 49/2020, registered at Police Station Budh Vihar, Delhi, for the commission of offence punishable under Section 363 of the Indian Penal Code, 1860 (hereafter 'IPC').

¶2Issue notice. The learned APP accepts notice on behalf of the State.

¶3The petitioner and respondent no. 2 are present before this Court and have been identified by their counsel and Investigating Officer (IO) concerned from Police Station, Budh Vihar, Delhi.

¶4Briefly stated the missing report in the present case was lodged by the complainant/mother of the victim herein, thereafter, the present FIR came to be registered against the present petitioner under the relevant sections. It is stated that the victim herein, who is present before this Court, was about 15 This is a digitally signed order. years of age at the time of the alleged incident. It is also stated that in her statement under Section 164 of Cr.P.C, she has not supported the case of the prosecution; instead she states that she already knew the present applicant, who was about 20 years of age at the time of the alleged. It is however stated that with intervention of the family and friends, the parties have now amicably settled their dispute vide Memorandum of Understanding (MoU) dated 04.04.2025.

¶5On a query made by this Court, respondent no. 2, who has been identified by the IO, has categorically stated that she has entered into compromise out of her own free will and without any pressure, coercion or threat.. Therefore, she has no objection if the present FIR is quashed.

¶6In view of the above, that the parties have amicably resolved their differences of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.

¶7Accordingly, FIR bearing No. 49/2020, registered at Police Station Budh Vihar, Delhi, for the commission of offences punishable under Section 363 of IPC and all consequential proceedings emanating therefrom are quashed.

¶8Accordingly, the present petition stands disposed of.

¶9The order be uploaded on the website forthwith. DR. SWARANA KANTA SHARMA, J NOVEMBER 17, 2025/vc This is a digitally signed order.
