¶1This hearing has been done through hybrid mode.

¶2The present petition has been filed by the Petitioner under Article 226 of the Constitution of India, inter alia, seeking issuance of an appropriate writ directing the Respondent for allotment of alternative Tehbazari site to the Petitioner.

¶3The brief background of the present case is that the father of the Petitioner was one of the Tehbazari holders in Azad Hind Market at Red Fort, Delhi and he was occupying Tehbazari site no. 3276 situated at Shop No. 39, Recruitment Office, Red Fort. The Petitioner thereafter replaced his father.

¶4When the land near Red Fort, Delhi was to be handed over to the Delhi Metro Rail Corporation (hereinafter, 'DMRC') for construction of the metro This is a digitally signed order. line, the Petitioner along with other Tehbazari holders were all assured that they would be given alternate sites. Thereafter, fifteen sites are stated to have been allotted in May, 2022 to various Tehbazari holders. However, no site was allotted to the Petitioner. Hence, the prayer in this petition is for allotment of an alternate site.

¶5Ld. Counsel for the Respondent-Municipal Corporation of Delhi (hereinafter, 'MCD') submits that there has been a delay in allotting the alternate site to the Petitioner.

¶6The concerned Assistant Commissioner, MCD i.e., Mr. Manish Kumar is present in Court. He submits that within a period of one month the alternate site would be allotted to the Petitioner.

¶7The responsibility of allotment of the alternate site shall be duly undertaken by the said Assistant Commissioner, MCD who is present in Court and in case of any non-compliance, stringent action would be liable to be taken as there has been sufficient delay in this matter.

¶8Accordingly, let the alternate site be allotted within one month to the Petitioner. If the Petitioner is not allotted a site within one month, he is at liberty to seek revival of this writ petition.

¶9The petition is disposed of. The pending application, if any, is disposed of.
