¶1The present petition is filed challenging the order dated
18.03.2024 passed by the learned Principal Judge, Family Court, South East District, Saket Courts, Delhi in execution case no.242/2022 titled as 'Inderwati vs. Dharmender Hooda', pursuant to which the warrant of attachment of immoveable goods was passed against the petitioners.
¶2By order dated 13.02.2019, the learned Family Court, noting the prevalent minimum wages in Delhi, granted an ad interim maintenance for a sum of ₹1,500/- per month by each of the petitioners to the respondent. The petitioners are the sons of respondent.
¶3All the relevant details in regard to the proceedings between the parties are not reflected in the present petition.
¶4On being pointedly asked, the learned counsel for the petitioners submits that the maintenance amount has not been This is a digitally signed order. paid due to financial difficulties.
¶5The petitioners have not denied their relationship with the respondent. On being asked, it is stated that the respondent is a senior citizen.
¶6Admittedly, the amount as directed by the learned Trial Court as an interim maintenance has not been paid and thus any order in regard to issuance of warrant of attachment of immoveable goods does not merit an intervention.
¶7Even otherwise, a sum of ₹1,500/- by each of the petitioners is too meagre an amount requiring any interference by this Court. It is unfortunate that the petitioners who are 48 and 40 years of age respectively are not even willing to pay a sum of ₹3,000/- to their mother which has led to filing of an execution petition in which the impugned order has been passed.
¶8The petition is, therefore, dismissed. AMIT MAHAJAN, J NOVEMBER 13, 2024 'Aman' This is a digitally signed order.
