¶1All the petitions in the present batch raise a common issue challenging the legality, validity and enforceability of the decision taken by respondent No. 1/NCTE in its 61st General Body Meeting ("GBM") held on

05.08.2024, wherein NCTE considered and approved submission of Performance Appraisal Review ("PAR") for academic sessions 2021-22 and 2022-23 by the teacher education institutions ("TEIs").

¶2On failure of the petitioners to submit the PAR for the concerned academic sessions, respondent No. 1 issued a Public Notice dated

02.04.2025, thereby informing its decision to issue show cause notices to institutions that did not submit the PAR for academic sessions 2021-22 and 2022-23.

¶3Subsequent thereto, vide various separate Withdrawal Orders, the respondent No. 1, as a consequence of non-submission of PAR, withdrew the recognition of the petitioners. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

¶4The petitioners, by way of the present petition, have impugned the said Withdrawal Orders passed by respective Regional Committees whereby recognition to conduct teacher training courses has been withdrawn.

¶5Most of the petitioners in the present batch were granted interim orders wherein the said Withdrawal Orders were stayed, permitting petitioners to grant admissions for academic sessions 2025-26 and 2026-27.

¶6The Hon'ble Supreme Court vide judgement dated 03.09.2026 in Civil Appeal No. 012179 of 2026 arising out of SLP(C) No. 11756 of 2023 titled as "The National Council for Teachers Education v. Association of NCTE Approved Colleges trust & Ors." upheld the power of respondent No. 1 to call for submission of PAR and also seek fees for the same. Relevant observations of the Hon'ble Supreme Court are reproduced as under: "We are not in agreement with the approach adopted by the High Court. When a High Court is called upon to examine the exercise of power by a statutory regulator, the approach must be to see whether the functioning of the authority is in violation of any mandatory provision or that it has transgressed the power that is vested in it. As the High Court was called upon to exercise judicial review over the power exercised by the Member Secretary, it is necessary to examine powers and duties in the context of the larger mandate of the Act and the Council. ….

¶17The statutory framework in which regulators are constituted, their duties and the functions as well as the necessity to ensure that they work effectively and efficiently are important to be borne in mind before exercising judicial review. ¶19It is evident from the above that while the issue relating to annual renewal of recognition became litigious, the Council found it necessary to insist on Performance Appraisal Report (PAR) to put in place a system of managing information system. In this view, the Council deliberated on the question and suitably modified the requirement of annual renewal recognition and called for a Performance Appraisal Report. Having deliberated upon the issue, the Council finally arrived at a decision, "approved as proposed, authorising NCTE to proceed in the manner through a proforma to be developed by NCTE for this purpose". ….

¶22We fail to understand as to how a regulatory measure of a statutory body, empowered to achieve planned and coordinated development of teacher education system in the country could be restrained from calling upon the TEIs to file Performance Appraisal Report. We are of the opinion that even without a specific empowerment under the statute, such a regulatory measure can always be incidental and ancillary to the duties and functions of a regulator. As there is a performance audit of NCTE itself by the Comptroller and Auditor General of India (CAG), it is but natural and incidental that NCTE would require the stakeholders, over which it exercises the regulatory jurisdiction, to provide the necessary Performance Appraisal Report. ….

¶24Apart from the duty to ensure that the executive The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. authority/statutory bodies do not exercise powers that are not vested in them, Constitutional courts also have a positive duty to ensure that Authorities, more particularly, the regulators do exercise their powers effectively, efficiently and in an accountable manner. In this context, Courts cannot adopt a technical or a pedantic view of the action taken by the regulators. ….

¶25The Public Notice, apart from requiring the Teacher Education Institution to upload Performance Appraisal Report on the designated portal also required the institutions to make certain payments. This payment is really in the nature of process fee which is again an incidental and ancillary power that the regulator must have."

¶7For the said reasons, the primary challenge in the present petitions, namely the validity of the decision taken by respondent No. 1 in its 61st GBM dated 05.08.2024 has been given up by the petitioners. In any event, I am of the view that the said challenge no longer survives in light of the aforesaid Judgement of the Hon'ble Supreme Court.

¶8The challenge remains with respect to the Withdrawal Orders passed, withdrawing the recognition of the petitioner institutes by various orders for non-submission of PAR.

¶9I am of the opinion that, considering the fact that the judgment of the Hon'ble Supreme Court bringing finality to the issue of validity of the PAR exercise was rendered only on 03.09.2026, and prior thereto, the petitioners' challenge to the said exercise was pending before this Court and the petitioners were also protected by interim orders passed by this Court, in the interest of justice, one further opportunity ought to be granted to the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. petitioners to submit their PAR, particularly now that their challenge has not succeeded.

¶10Since the regulatory objective would stand substantially served by permitting the petitioners to submit the PAR, I am of the view that, in the larger public interest, one further opportunity ought to be granted to the petitioners to do so. Needless to say, Respondent No. 1 shall remain at liberty to take such action as may be permissible in law, in the event the petitioners fail to comply within the time granted.

¶11Accordingly, the impugned Withdrawal Orders are set aside.

¶12In view of the aforesaid, it is directed Respondent No. 1/NCTE shall accordingly pass consequential orders restoring the recognition of the petitioners/reinstating the petitioners' names in the list of recognised institutions, subject to the directions below.

¶13The respondents shall issue a public notice within 10 days of this order, informing the petitioners of the opening of the portal for uploading the PAR.

¶14The respondents shall open the portal for a period of 10 days, commencing from the date of the aforesaid public notice, during which the petitioner institutions shall be permitted to upload their PAR for the academic sessions 2021-22 and 2022-23.

¶15While scrutinizing the PAR, the respondents shall keep in mind that information relating to the students who studied in the academic years 2021, 2022 and 2023 may not be readily available with the petitioner institutions. If any information or proforma is not available with certain petitioner institutions because it is not within their power or possession, the respondents shall take this into account at the time of scrutiny. ¶16No further liberty shall be granted after the expiry of the period stated in the public notice to be issued by respondent No. 1. The petitioner institutions shall therefore upload their PAR within that period. The respondent No. 1 shall be at liberty to take action in accordance with law for non-submission of the PAR or for any deficiencies in the same.

¶17With the above directions, the present petitions along with any pending applications is disposed of.
