¶1The applicant/accused seeks anticipatory bail in case FIR No. 108/2026 of Police Station Rajouri Garden, West Delhi for offence under Section 140(2)/309(6)/311/3(5) BNS.

¶2Broadly speaking, allegation against the accused/applicant is that he and his co-accused impersonated as police officials and abducted the victim and robbed him of his Range Rover car, cash of Rs. 40,00,000/-, jewellery and mobile phones.
¶3In the previous anticipatory bail application, after addressing partly, learned counsel for accused/applicant sought and was allowed to withdraw that anticipatory bail application with liberty to raise same pleas after surrender of the accused/applicant.
¶4It is the accused/applicant, who through his counsel stated on
12.08.2026 during the hearing of the earlier anticipatory bail application that he wanted to surrender and raise same pleas, as raised in the said application for anticipatory bail.
¶5But instead of surrendering, the accused/applicant has filed this second anticipatory bail application. It is contended on behalf of accused/applicant that on account of his ill health, he could not surrender.
¶6Learned APP for State assisted by Investigating Officer/Inspector Mahesh and learned counsel for complainant de facto strongly oppose this second anticipatory bail application, pointing out that even otherwise, the medical records filed with the present application do not inspire confidence as the same pertain to the year 2022-2023. Further, learned APP also points out that it is not believable that the accused/applicant, who is a resident of Ludhiana, would go to Bhunga, Hoshiarpur, which is about 110 kms away

¶7Besides, it is also strange to notice that on the one hand, the accused/applicant has again sought anticipatory bail despite previous withdrawal, but on the other hand, he also seeks (by way of CRL.M.A. 26625/2026) eight weeks time to surrender.
¶8In view of above discussion, this second application for anticipatory bail and the accompanying applications are dismissed.
