¶4The petitioners and respondent no. 2 appearing through video conferencing (VC) have been duly identified by their respective learned counsel as well as the concerned Investigating Officer (IO).
¶5Briefly stated, the aforementioned FIR was registered pursuant to an application filed by respondent No. 2 under Section 156(3) of the Code of Criminal Procedure (hereinafter referred to as 'Cr.P.C') in relation to a commercial dispute between the parties. Upon completion of the investigation, a Final Report was filed, wherein petitioner No. 1 was placed in Column No. 12 and was not charge-sheeted. Respondent No. 2 thereafter filed a protest petition, which is stated to be pending as Cr. Case No. 25332/2019, titled "State v. Pawan Solanki".
¶6The same underlying dispute also resulted in proceedings under Section 138 of the Negotiable Instruments Act, 1881 (hereinafter referred to as 'NI Act'), instituted by petitioner No. 2 against respondent No. 2. Respondent No. 2 challenged those proceedings before this Court in CRL.M.C. 2286/2025, wherein notice was issued and interim protection was granted on 04.04.2025.
¶7During the pendency of CRL.M.C. 2286/2025, the parties expressed their willingness to amicably resolve their disputes. Accordingly, vide order dated 01.09.2025, the parties were referred to the Delhi High Court Mediation and Conciliation Centre. ¶8The mediation proceedings culminated in a Settlement Agreement dated 28.05.2026. Under the said Agreement, the parties resolved the disputes covered thereunder, including the proceedings arising from the Section 138 complaint, FIR No. 84/2018 and the aforementioned FIR. They further agreed to take the necessary steps and cooperate with each other for obtaining appropriate orders of quashing from the competent Courts.
¶9The present petition has accordingly been instituted to give effect to the Settlement Agreement dated 28.05.2026 and to seek quashing of FIR No. 249/2013 and the proceedings emanating therefrom.
¶10On a query made by this Court, respondent No. 2, who has been duly identified by the IO, has stated that she entered into the Settlement Agreement dated 28.05.2026 of her own free will and without any pressure, coercion, undue influence or threat. She has further stated that she has no objection if the aforesaid FIR is quashed.
¶11In view of the above, since the parties have amicably resolved their differences of their own free will and without any pressure, coercion, undue influence or threat, no useful purpose would be served by continuing the proceedings. Rather, continuation of the proceedings may only give rise to further acrimony between the parties. In these circumstances, this Court is of the view that the interest of justice would be served by bringing the proceedings to an end. Accordingly, the aforesaid FIR and all proceedings arising therefrom are liable to be quashed.
¶12Therefore, FIR No. 249/2013, registered at Police Station New Friends Colony, District South East, Delhi for offences punishable under Sections 420/467/468/471 of the IPC, 1860, along with all consequential proceedings emanating therefrom, is hereby quashed.
