24.08.2026 CRL.M.A. 26076/2026 & CRL.M.A. 26105/2026 (for exemption)

Exemption allowed, subject to all just exceptions. BAIL APPLN. 3502/2026

¶1Applicant seeks anticipatory bail in case FIR No. 285/2025, registered at Police Station Special Cell for commission of offences under Sections 318/(4)/319/336(3)/340/61(2)/3(5) of Bharatiya Nyaya Sanhita, 20213 (corresponding Sections 420/419/468/470/120-B/34 IPC).

¶2The aforesaid FIR was registered on the basis of complaint made by one Mr. Rajeev Hajela, who alleged that he had been induced, through a WhatsApp group to invest in purported IPOs and block deals under the guise The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. that the transactions would be under Standard Chartered Securities Limited. The complainant was made part of the WhatsApp titled as "SCSIL-109 Marketing Strategy Sharing Hub". He and his family members transferred a sum of Rs. 2,67,21,000/- into ten different bank accounts through seventeen transactions.

¶3One such account was of Axis Bank which was in the name of M/s P.R. Traders in which a sum of Rs. 52 lacs had been transferred by the complainant.

¶4Investigation revealed that such account had been opened by Parvez Ahamad and Rehana. When Parvez Ahamad was contacted and interrogated, he disclosed that he had been induced by Athar Jamal Idrishi @ Pintu. Said Athar Jamal Idrishi was arrested on 13.06.2026 and in his disclosure statement, he revealed that the fraudulent scheme was orchestrated by Deepak (applicant herein) and by one Hemant and that shell accounts were opened for them and the entire fraudulent transactions were managed by Deepak.

¶5Admittedly, the applicant did join the investigation earlier on

29.07.2026. He, as alleged, admitted his involvement by claiming that he had arranged fake bank account of M/s P.R. Traders as well as other accounts and had received commission. He, however, refused to assist the investigation in the desired manner as he did not reveal the whereabouts of his absconding associates. He also deleted WhatsApp chats and other relevant and sensitive data from his mobile device.

¶6Learned Sessions Court dismissed his anticipatory bail application while observing that his custodial interrogation would be imperative. It took note of the fact that investigating officer had, specifically, stated that The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. applicant had deleted WhatsApp chats and data from his mobile phone and that his associates were absconding and the applicant had not disclosed about their current addresses. It is also observed that recovery of the proceeds of the crime remained to be affected and, therefore, declined to release the applicant on anticipatory bail.

¶7Learned counsel for applicant submits that applicant had already assisted in the investigation and is ready to join investigation as and when directed and that he is even ready to hand over his mobile device for thorough forensic examination. It is also argued that applicant is not named in FIR and has been implicated solely on the basis of disclosure statement of a co-accused which is weak piece of evidence as such statement does not constitute substantive evidence. He also contends that there is nothing on record which may indicate that applicant is beneficiary as no amount ever landed in his personal account. He submits that personal liberty of the applicant cannot be frustrated when there is no possibility of his fleeing from justice and when he is ready to render due assistance to the investigating agency. He also contends that on the touch stone of parity, he is entitled to be released on bail as co-accused Parvez Ahamad, who is allegedly the account holder of M/s P.R. Traders has, merely, been bound down and was not even arrested.

¶8Learned Addl. P.P. for State, however, refutes all the aforesaid contentions and submits that custodial interrogation is very much essential. He submits that the alleged account of M/s P.R. Traders, where a sum of Rs. 52 lacs was transferred, was funded with a sum of Rs. 5 lacs from the saving account of Parvez Ahamad and such saving account of Parvez Ahamad was also, initially, funded with a sum of Rs. 5 lacs which came from the bank The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. account of M/s Deepak Enterprises only. The applicant herein is the account holder of M/s Deepak Enterprises and, therefore, his complicity is evident. He submits that disclosure statements of co-accused cannot be brushed aside in a casual manner, particularly when such co-accused has, categorically, claimed the applicant herein to be the main perpetrator. It is also submitted that despite there being formal notice under Section 35(3) of Bharatiya Nagarik Suraksha Sanhita, 2023, applicant, wilfully, chose to abscond and evade the process of law and his failure to join investigation and attempt to destroy the evidence cannot be disregarded. It is argued that he is a key link in the sophisticated cyber fraud syndicate that had swindled the victim over Rs. 2.67 crores. He submits that as per NCRP portal, account is involved in ten other cases and even account of the present applicant i.s. M/s Deepak Enterprises is involved in one other complaint of Mumbai

¶9Such type of cases related to cyber fraud are on the rise and keeping in mind the material placed on record, it becomes very much evident that the custodial interrogation of the applicant would be imperative to reach the root of the matter and to unearth the complete nexus and conspiracy.

¶10Therefore, finding no merit and substance in the present application, same is accordingly dismissed.

¶11It is, however, clarified that the observations, as above, are merely for the purposes of adjudication of bail and shall not be taken as final expression over the merits of the case.
