Judgment

24.08.2026

¶1This hearing has been done through hybrid mode. CRL.M.A. 25932-33/2026 (for exemption)

¶2Allowed, subject to all just exceptions. Accordingly, these applications stand disposed of. BAIL APPLN. 3482/2026

¶3The present bail application has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the 'BNSS'), seeking regular bail in FIR No. 250/2023, registered at Police Station Chanakya Puri, New Delhi, for offences punishable under Sections 365, 394, 397, 411 and 34 of the Indian Penal Code, 1860 (hereinafter referred to as the 'IPC') and Sections 25 and 27 of the Arms Act, 1959 (hereinafter referred to as the 'Arms Act') . This is a digitally signed order. 4. Learned counsel for the Applicant submits that the Applicant has been in judicial custody for more than two years and the complainant in the present case has already been examined.

¶5Learned counsel further submits that the complainant is a resident of Rajasthan and there is no apprehension that the Applicant would influence the witness.

¶6Learned APP for the State, appearing on advance notice, submits that the allegations are quite heinous and that the Applicant is involved in 24 other cases.

¶7I have heard learned counsel for the Applicant and learned APP for the State.

¶8The record reflects that there are 24 previous involvements of the Applicant. Though learned counsel submits that the Applicant is on bail in the said cases, his repeated involvement in criminal cases cannot be ignored and shows that he has been misusing the liberty granted to him.

¶9Merely because the complainant has already been examined cannot, by itself, constitute a sufficient ground to enlarge the Applicant on bail.

¶10Considering the submissions made and the fact that the Applicant has 24 previous involvements, this Court is of the view that no ground for grant of bail is made out.

¶11Accordingly, the present application is dismissed. Pending application(s), if any, also stand disposed of.

¶12The order be uploaded on the website forthwith. MADHU JAIN, J AUGUST 24, 2026/JYH/m This is a digitally signed order.
