¶3Regular First Appeal under Section 96 CPC has been filed against the Judgment and Decree dated 18.05.2026 of learned District Judge has affirmed the Suit of the Plaintiff for Declaration of the Sale Deeds as not maintainable.

¶4Learned counsel for the Appellant states that there is a prior Suit No.3228/2015 pending in this Court in regard to the MOU and the mediated Settlement. The subsequent events are the execution of the Sale Deed which would naturally fall subject to the decision in the year Suit. This is a digitally signed order. 5. After some submissions, learned counsel for the Appellant seeks permission to withdraw the present Appeal with liberty to pursue his remedies in accordance with law.

¶6In view of the submissions made, the Appeal is permitted to be withdrawn with liberty to both the parties to agitate their respective cases in accordance with law.

¶7The Appeal stands disposed of accordingly along with the pending Applications.
