Judgment

21.08.2026

¶1Petitioners seek quashing of case FIR No. 230/2026 of Police Station Dayal Pur for offence under Section 85/316(2)/3(5) BNS and Section 4 of The Muslim Women (Protection of Rights on Marriage) Act, on the ground that the complainant de facto (respondent no. 2) has settled the disputes with the petitioners.

¶2As per the FIR, the present petitioner no.1 pronounced triple talaq. But at the same time, it is also alleged that the respondent no.2 is living with the petitioners, which is not understandable as there are no pleadings of re-marriage. Further, there are serious allegations of sexual misconduct against brother-in-law of the present respondent no.2. This is a digitally signed order. 3. Learned counsel for petitioners, on instructions of his clients present in court, seeks permission to withdraw this petition so that they face trial.

¶4Accordingly, the petition and accompanying application are dismissed as withdrawn.
