NAVIN CHAWLA, J. (ORAL) CM APPL. 54489/2026 & CM APPL. 54492/2026 (Exemption)

¶1Allowed, subject to all just exceptions. MISC. APPEAL(PMLA) 113/2026 & CM APPL. 54490/2026, CM APPL. 54491/2026

¶2This appeal has been filed under Section 42 of the Prevention of Money Laundering Act, 2002 (in short, 'PMLA') against the order

18.11.2025 passed by the Appellate Tribunal (PMLA), New Delhi in FPA-PMLA-5856/DLI/2023 titled Mr.Dharampal v. The Deputy

MISC. APPEAL(PMLA) 113/2026

Director, Directorate of Enforcement.

¶3This appeal has been field with a delay of 29 days in filing, and another 160 days in re-filing the same.

¶4Section 42 of the PMLA states that the appeal shall be filed within a period of 60 days from the date of the communication of the decision or the order of the learned Appellate Tribunal to the appellant, and further restricts the power of the High Court to condone the delay, even when sufficient cause is shown, to a period not exceeding 60 days.

¶5In the present case, as we have noted hereinabove, there will be a delay of almost 189 days.

¶6The grounds urged in the application for condonation of delay are routine, and bureaucratic in nature.

¶7We, therefore, dismiss the application seeking condonation of delay in filing and re-filing of the appeal, and consequently, the present appeal is also dismissed on the ground of limitation.

¶8We, however, leave the question of law open to be raised in an appropriate proceeding.
