C.M. No.7377/2017 (for withdrawl of amount) By way of this application applicant-appellant –Judgment Debtor seeks release of amount of `1,53,000/- deposited with the Registry during pendency of this appeal. This appeal has been disposed of and occasion to file this application is an order of 3rd February, 2017 vide which the executing court issued warrants of attachment against applicant-appellant –Judgment Debtor. Order of 3rd February, 2017 does not indicate as to for what amount warrants of attachment have been issued. As per office noting, the deposited amount of `1,53,000/- is lying in shape of FDR. In view of the above, the Registry to transmit forthwith the deposited amount of `1,53,000/- with interest accrued thereon to the court of Ms.Savita Rao, ADJ (West District) Tis Hazari Courts to liquidate the outstanding decreetal amount, and after satisfaction of decree, if any amount is in excess, it be released to applicant-appellant-Judgment Debtor. At this stage, learned counsel for applicant-appellant-Judgment Debtor points out that if deposited amount is released to Judgment Debtor, it would satisfy the decree. If it is so, then no coercive steps be taken against Judgment Debtor till next date of hearing before the executing court i.e. 31st March, 2017. With the aforesaid directions, this application is disposed of. Dasti.
