¶1The present appeal has been filed under Section 37(1)(B) of the Arbitration and Conciliation Act, 1996 read with Section 13 of Commercial Courts Act, 2015 assailing the Order dated 30.07.2026 passed by the learned Single Judge in OMP(I)(COMM) No. 299 of 2026.

¶2We have heard learned senior counsel for the parties.

¶3Both the parties submit that they are agreeable to resolving their disputes through arbitration. It is further submitted that the parties have already appointed one arbitrator each and, accordingly, seek appointment of a This is a digitally signed order. third arbitrator. We find it appropriate to appoint Mr. Justice Ashok Bhushan, Judge of the Supreme Court (retired) as the third arbitrator.

¶4The parties are at liberty to raise all their requests/grievances/grounds before the learned arbitrators. All questions are left open to be decided by the arbitrator.

¶5It is also provided that for a period of 30 days from today, the bank guarantees lying with the respondent shall not be encashed and the same shall be subject to any orders passed by the learned arbitrators.

¶6With the aforesaid directions, the appeal stands disposed of. All pending applications also stand disposed of.

¶7Interim orders, if any granted earlier, also stand discharged.
