¶1This Application under Order XXIII Rule 1 of the CPC has been filed on behalf of the Plaintiff for withdrawal of the Suit on the ground that the parties have decided to have all their dispute adjudicated by way of Arbitration.

¶2Permission, as prayed for, is granted.

¶3Liberty is also granted to the Plaintiff to raise the claim, as raised in the present Suit, before the arbitral tribunal in accordance with law.

¶4The Application allowed.

¶5Accordingly the Suit is disposed of as withdrawn, along with the pending applications, if any. This is a digitally signed order. 6. The date already fixed, i.e. 03.09.2026, stands cancelled.
