Accordingly, both accused Rihan @ Rizwan and Sakib @ Azeem are hereby convicted for the commission of offences u/sec. 393/34 IPC. Further, accused Rihan @ Rizwan also stands convicted for the commission of offence u/s 398 IPC.

¶4Learned counsel for the petitioner submits that no injury was caused to the complainant. It is further submitted that no damage was caused to the car and that the prosecution failed to conduct any mechanical inspection of the vehicle to establish the alleged damage. Learned counsel further submits that the co-accused has been sentenced to imprisonment for the period already undergone by him by this court and, the petitioner be granted parity with the co-accused.

¶5Learned APP for the State submits that although the co-accused has been sentenced to imprisonment for the period already undergone, the role attributed to the present appellant is distinct, as he was found in possession of a knife. It is further submitted that the appellant has been sentenced to undergo imprisonment for a period of seven years, as against five years awarded to the co-accused. Learned APP further submits that the appellant has several criminal antecedents, with 28 cases registered against him. However, it is fairly conceded that the appellant has not been convicted in any of the said cases and that there is no previous conviction on record. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

¶6At this stage, learned counsel for the petitioner submits that the petitioner is not challenging his conviction and seeks leniency in the sentence imposed upon him.
