Judgment
J U D G M E N T
MANMOHAN, J: (ORAL)
¶1The present petition has been filed for quashing of FIR No. 412/2005 registered with PS Hazrat Nizamuddin under Sections 324 and 308 IPC.
¶2Briefly stated, the facts of this case are that on 14th June, 2005, there was an altercation between the Petitioner, Desh Raj, and Satbir Singh, Respondent No. 2, who belong to the same Department of
Horticulture, Sub-Division-III, Govt. Sunder Nursery, Nizamuddin, New Delhi.
¶3On 16th June, 2005, on a complaint being filed by the Respondent No. 2, the present FIR was registered and subsequently a challan was also filed which is now pending before Shri V.K. Bansal, ASJ, New Delhi.
¶4However, on 13th March, 2007, the Petitioner and the Complainant amicably resolved all their disputes and the Complainant has filed an affidavit stating that he is no longer willing to pursue the case any further. Shri Satbir Singh, who is present in Court and who has been identified by the IO, ASI Ramesh Chand, makes a statement that he has no objection if the complaint filed by him is quashed.
¶5Consequently, I see no useful purpose in allowing the present proceedings to continue any further. Accordingly, I quash the FIR No. 412/2005 registered with PS Hazrat Nizamuddin under Sections 324 and 308 IPC as well as the proceedings arising therefrom and now pending before the Court of Shri V.K. Bansal, ASJ, New Delhi.
¶6The petition is allowed in the above terms.
