¶1Pursuant to directions passed by the Court, the Trial Court has sent the report. It has been pointed out that the evidence of PW-3 could not be completed on account of non-availability of FSL report.

¶2Mr. Mukesh Kumar, learned APP for State, on instructions, however, submits that the FSL report has been received and the same would be filed soon by way of the supplementary charge sheet before the Trial Court.

¶3It is, thus, seen that there is no impediment in completion of the evidence of PW-3/ victim. Besides the evidence of PW-3, the learned Trial Court is directed to record the evidence of witness namely, Vijay Dujana, who is mentioned at serial no.14 in the charge sheet. The evidence of both This is a digitally signed order. the witnesses shall be recorded by the Trial Court without any futher delay.

¶4Learned counsel appearing on behalf of the applicant, at this stage, seeks liberty to withdraw the instant application with further liberty to file it afresh before the Trial Court once the evidence of the aforesaid witnesses is fully recorded.

¶5Liberty, so prayed for, is granted.

¶6The instant application, at this stage,stands dismissed as withdrawn. Pending application also stands disposed of.
