ORDER

25.09.2024 Heard Mr S M Abdullah P, learned counsel for the petitioner, Dr Mridu Paban Nath, who has filed this application under Section 483 of the BNSS, 2023, with prayer for bail as he is behind bars since 07.09.2024, in connection with Mangaldoi PS Case No. 232/2024, under Sections 316(2)/319(2)/336(3)/340(2) of the BNS, 2023. ¶2Heard Mr M Phukan, learned Public Prosecutor for the State of Assam.

¶3The allegation against the petitioner is that he has forged the documents and forwarded the same to the CM Vigilance Cell during the absence of the informant.

¶4Learned Public Prosecutor has raised serious objection stating that there are incriminating materials in the Case Diary against the petitioner.

¶5I have scrutinized the Case Diary.

¶6Indeed, there are incriminating materials in the Case Diary, against the petitioner.

¶7However, petitioner has been behind bars since 07.09.2024 and investigation has also progressed to a considerable extent.

¶8It appears that investigation may not be adversely affected, if the petitioner is admitted to bail.

¶9Considering all aspects, petition is allowed. The petitioner is enlarged on bail on furnishing bail bond of Rs. 50,000/-, with a suitable surety of the like amount to the satisfaction of the learned CJM, Darrang, Mangaldoi, under the condition that the petitioner shall cooperate with the remaining part of investigation.

¶10Bail Application stands disposed of.
