18/12/2024 Heard Mr. S K Sarkar, learned counsel for the petitioner and Mr. K K Parashar, learned Additional Public Prosecutor, Assam for the State respondent. This application under Section 483 of BNSS, 2023 has been filed by the petitioner, namely, Sri Herod Mushahary, seeking bail in Gossaigaon P.S. Case No. 178/2024 registered under Sections 303(2)/317(2) BNS read with Section 13(1) of Assam Cattle Preservation Act, 2021 Page No.# 2/2 corresponding to G.R. No. 202/2024, wherein he was arrested on 28.10.2024 and is in custody since then. It is seen that the petitioner has filed this bail application on 21.11.2024, much after filing of the charge-sheet on 28.10.2024. During the deliberation of the matter, Mr. Parashar, learned Additional Public Prosecutor, Assam, on instructions submitted that police after completion of investigation of the case has already submitted charge-sheet in the said Gossaigaon P.S. Case No. 178/2024 vide Charge-Sheet No. 146/2024 dated 31.10.2024. In view of the above, the petitioner may approach the appropriate forum for his regular bail in said Gossaigaon P.S. Case No. 178/2024. With the above observation and direction, this bail application stands disposed of.
