Himangshu Talukdar v. The State of Assam

ORDER 12-12-2024 Heard Mr. B K Das, learned counsel for the petitioner and Mr. M Haloi, learned Special Public Prosecutor, CBI for the respondent.

¶2By this application under Section 482 BNSS, 2023, the petitioner, namely, Shri Himangshu Talukdar, son of late Mahodar Talukdar, resident of Ambari, Fatashil, Sankar Page No.# 2/2 Path, District-Kamrup (Metro), apprehending his arrest, is seeking pre-arrest bail in Azara Police Station Case No. 184/2024 registered under Sections 61(2)/316(2)/318(4) of the BNS, 2023 read with Sections 21(1)(2)(3)/23 of the Banning of Unregulated Deposit Scheme Act, 2019.

¶3In the meanwhile, investigation of said Azara Police Station Case No. 184/2024 has been handed over to the CBI and the same has been re-registered at CBI/ACB/Guwahati vide Case No. RC0172024E0005 on 20.10.2024.

¶4During the deliberation of the matter, M Haloi, learned Special Public Prosecutor, CBI, on instruction, has submitted that CBI after completion of the investigation of the case has already submitted Charge-Sheet in said Case No. RC0172024E0005 vide Charge Sheet No. 18/2024 dated 10.12.2024.

¶5In view of the above, the petitioner is directed to appear before the appropriate forum/authority for his regular bail in said Case No. RC0172024E0005.

¶6Accordingly, this pre-arrest bail application stands disposed of.
